On 29 June 1654, "Goodman Greene, Robert Waymouth, & James Emery" were co-defendants in a civil suit.7

On 12 May 1660, "Anthony Emery of Kittery ... and Francis my wife" sold to "my son James Emery ... my house and all my land" in Cold Harbor, Kittery, with one hundred acres of upland on the south side of Sturgeon Creek, and a little marsh, and a piece of meadow and some upland near Mast Creek.8

By 3 July 1660, son James Emery was defending his father in court in the matter of two debts.9

Letters of administration were granted to James Emery on "Robert Waymouth his estate" 7 July 1663.10

On 7 July 1663, James Emery petitioned "about freeing his father Anthony Emery from a bond of £20 forfeit to the county for Tho[mas] Sadler his non-appearance for whom he was bound."11

James Emery had grants of land in Kittery, 1653, 1656, 1669, 1671; was selectman of Kittery, 1674, 1676, 1677, 1684, 1685, 1692, 1693, 1695; elected representative to the General Court, 1693, 1695, at which time he probably lived in Dedham; grand juror and constable, 1670.1

It is related of him that when he went to Boston his carriage was a chair placed in an ox cart drawn by a yoke of steers. This mode of conveyance was necessary as there was not in Kittery a carriage large or strong enough to carry him safely. He was a large man weighing over three hundred and fifty pounds.1

10 May 1700, "James Emery of Dedham in New England, the only surviving son of Anthony Emery late of Portsmouth on Rhode Island and Providence Plantations deceased, quitclaims to his sister Rebecca Sadler alias Eaton, lands, estate Goods and Chattels of said Anthony Emery late deceased."1

On 10 May 1700 James Emery deeded land to "my sister Rebecca Eaton alias Sadler."12

In 1713, James Emery gives a deed in which he describes himself as of Berwick.1
